To clamp down on a collector: how a new law on debt collecting will help the citizens

Sergey Soldatenko, head of the projects, has commented on new provisions of the law on collectors to RBK Money.

State Duma adopted in three readings a bill on collectors, where all rules of interactions between collectors and debtors are specified. What should citizens know about new regulations?

On June 21 State Duma has adopted in a third reading a bill controlling work of collectors. It specifies rights of citizens and actions of collectors in details. The Law “On protection of rights and of legitimate interests of individuals during collection of debts” is planned to come into effect on January 1, 2017 <...>

Whom can a collector contact with?

Relatives, friends and neighbors of the debtor (unless they are pledgers) will not be persecuted by collectors. Communication with debtor’s friends per social networks and any other kind of interactions with anyone except the debtor are forbidden. “There is another important thing, the bill specifies list of debtors with whom the collectors cannot work, says Sergey Soldatenko, head of projects of Pavlova&Partners law firm. - It includes bankrupts, legally incapables, persons with disabilities, people undergoing treatments in day and night clinics, category I disabled persons”.
