Sergei Soldatenko, project manager at Pavlova&Partners law firm, took part in the first Legal Forum of Black Earth region that was held from 7^th to 8^th October 2016 in Voronezh city.

Sergei gave a report within section of “Current issues in the field of civil legislation”. He told about compensations for violation of exclusive rights.

According to S. Soldatenko, the number of legal controversies concerning intellectual rights protection in Russia has nowadays essentially increased. At that right-holders need to be sure that the court will completely make up all financial losses caused by violation of exclusive rights.

“In most cases right-holders use such protection method as recovery of compensation. However, Russian courts don’t recover compensations in the amount of actual losses suffered by right-holders”, - says S. Soldatenko.

The specialist says that one of the reasons of the current situation is “the absence of clear criteria that shall be taken into account by the courts when defining amount of compensation”.
